Information you give us directly

Contact details: your name, email address, phone number, and mailing or delivery address when you fill out a form, book a showing, sign up for texts or emails, request pricing, or place an order.

Order and delivery details: the products you buy, the delivery address, site access notes, and any photos or measurements you send us to plan a delivery or installation.

Payment information: when you pay online, your card details are collected and processed by our payment processor and are not stored on our servers. When you pay in person, we keep only the transaction record.

Financing application information: if you apply for in-house financing, we collect the information needed to evaluate and service your application, which may include your date of birth, Social Security number, employment and income information, and a credit report obtained with your authorization. This information is used only for the financing decision and the administration of your account.

Signed documents: sales agreements and related paperwork you sign electronically through our e-signature provider.

Communications: anything you tell us by phone, email, text, chat, or in person, including reviews and testimonials you choose to give us.

Information collected automatically

When you use our website, our website platform and analytics tools automatically collect device and usage data such as your IP address, browser type, operating system, the pages you view, the time you spend on them, and the site that referred you. We may receive information about you from our financing partner, our payment processor, our e-signature provider, social media platforms where you interact with us, and public sources such as Google Business Profile reviews.

We use personal information to respond to your inquiries and provide quotes; schedule and confirm showings, consultations, and delivery or installation appointments; process orders, payments, and financing applications, and service financed accounts; deliver, install, service, and support the products you buy from us; send transactional messages about your order, appointment, or account; send marketing emails and, where you have opted in, SMS text messages; operate, secure, and improve our website and services; comply with legal obligations and enforce our agreements; and protect against fraud and misuse.

How We Share Your Information

We do not sell your personal information. We share it only as described here.

Service providers that help us run the business: our website and e-commerce platform (Wix), payment processors, our e-signature provider, cloud document storage, email and SMS delivery services, scheduling tools, and delivery and installation subcontractors who need your address and contact details to complete a job.

Financing: when you apply for financing, we share your application information with credit reporting agencies and, for larger backyard projects, with our third-party financing partner (HFS Financial) when you choose to apply with them.

Legal and safety: when required by law, subpoena, or court order, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business transfers: if the business is sold, merged, or reorganized, customer information may be transferred as part of that transaction.

With your consent: in any other case where you ask us to share it.

SMS and text messaging data: mobile phone numbers and text-messaging opt-in data are never shared with third parties or affiliates for their marketing or promotional purposes. We share mobile information only with the vendors that deliver our messages, and only so they can deliver them.

Email and SMS Marketing

Email: you can unsubscribe from marketing emails at any time using the link in any email or by contacting us. We will still send transactional emails about your orders and appointments.

SMS: by checking the consent box on our website or otherwise opting in, you agree to receive text messages from TX Spa Guy (C&A Sales LLC), which may include appointment reminders, order and delivery updates, and occasional marketing offers. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out and HELP for help. Consent to receive texts is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages.

Do Not Track: our site does not currently respond to browser "Do Not Track" signals.

Data Retention

We keep personal information for as long as needed for the purposes described above. Customer order records, signed agreements, and financing files are retained for the periods required by tax, accounting, lending, and warranty obligations, and are then deleted or anonymized.

Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, and we rely on established providers for payment processing, e-signatures, and document storage. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Children

Our website and services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
