Terms of Service

These Terms of Service ("Terms") govern your use of txspaguy.com (the "Site") and every purchase, booking, financing application, or service you obtain from TX Spa Guy, the trade name of C&A Sales LLC, a Texas limited liability company ("TX Spa Guy," "we," "us," or "our"). By using the Site, placing an order, booking an appointment, or signing a sales agreement, you agree to these Terms. If you sign a written sales agreement with us, that agreement controls if it conflicts with these Terms.

Products, Pricing, and Availability

We sell new and certified-used hot tubs, swim spas, covers, and accessories, and we provide backyard services such as concrete pads, electrical coordination, decking, pergolas, turf, and pickleball courts.

Prices shown on the Site are in U.S. dollars and exclude sales tax, delivery, installation, electrical work, site preparation, and crane or special-access charges unless the listing says otherwise.

Where a listing shows a manufacturer's suggested retail price (MSRP), or a "new MSRP" for a used unit, that figure is the manufacturer's list price for reference only. It is not a price at which we have offered or sold that unit.

Weekly specials shown on our home page apply only to the unit named, only while the special is posted, and only to orders placed with a deposit during that period.

Most of our inventory is one of a kind. A unit is sold only when we receive a deposit and a signed sales agreement; until then it may be sold to another customer even if it is still shown on the Site. We may correct pricing or listing errors and cancel any order placed at an incorrect price, with a full refund of any amount paid.

Certified-Used Units

"Certified-used" means the unit was inspected and tested by us before being offered for sale. Any manufacturer warranty that remains on a used unit is transferred only if the manufacturer allows it.

New Units

New units are units that have not been previously owned. Any manufacturer warranty that accompanies a new unit is provided by the manufacturer under the manufacturer's own terms, and any warranty service is performed under those terms.

 

Warranty Disclaimer

UNLESS YOUR SIGNED SALES AGREEMENT STATES OTHERWISE, ALL UNITS, NEW AND CERTIFIED-USED, ARE SOLD AS IS, WITH ALL FAULTS, AND WITHOUT ANY WARRANTY FROM TX SPA GUY, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any warranty we provide is valid only if it is in writing and signed by us.

Orders, Deposits, and Payment

A deposit is required to hold a unit or schedule a project. The deposit amount, the balance due date, and the refund terms are stated in your sales agreement.

We accept cash, check, major credit cards, and approved financing. Payments made through the Site are processed by our payment processor; by submitting payment information you confirm you are authorized to use that payment method.

Returned checks and disputed card charges are subject to a returned-payment fee plus any bank charges.

Orders cancelled after a unit has been reserved for you, or after a project has been scheduled, are subject to forfeiture of the deposit as described in your sales agreement. Custom-ordered units cannot be cancelled once the manufacturer has accepted the order.

Financing

We offer in-house financing on spas to qualified buyers. Terms are set out in a separate retail installment agreement, which controls.

For larger backyard projects we may refer you to a third-party lender such as HFS Financial. Any loan with a third-party lender is between you and that lender and is governed by their terms, not ours.

Financing is subject to credit approval. Submitting an application authorizes us or our financing partner to obtain a credit report.

Delivery, Site Preparation, and Access

Most delivery problems come from site preparation, so please read this section carefully.

Delivery dates are estimates. We will confirm a delivery window with you and do our best to keep it, but we are not liable for delays caused by weather, road conditions, manufacturer shipping, or circumstances beyond our control.

Unless we have agreed in writing to do it, you are responsible for site preparation before delivery: a level, properly engineered pad or deck capable of supporting the filled weight of the unit; a clear access path from the street to the pad wide enough and clear enough for the unit and delivery equipment (we will tell you the dimensions); removal of fence panels, gates, landscaping, or structures in the path; and any permits your city or HOA requires.

Electrical work must be performed by a licensed electrician to the manufacturer's specifications and local code. We can refer you to electricians we work with. We are not responsible for electrical work performed by others.

If the site or access path is not ready when we arrive, the delivery may be rescheduled and a return-trip fee applies. If a crane or special equipment is needed because of access conditions, that cost is passed through to you.

Deliveries outside Texas are arranged through freight carriers. The carrier's terms govern transit, and any transit damage must be noted on the delivery receipt at the time of delivery.

Please inspect the unit at delivery and note any damage on the delivery paperwork before the crew leaves. Cosmetic issues not noted at delivery are presumed to have occurred afterward.

Risk of loss passes to you when the unit is set in place at your property or, for freight shipments, when the carrier takes possession.

Backyard Services

Concrete, decking, pergola, turf, and pickleball court work is performed under a written proposal or sales agreement that sets out scope, price, and schedule.

You are responsible for locating and marking private utilities, septic systems, sprinkler lines, and property lines before work begins, and for obtaining HOA approvals. We arrange public utility locates.

Changes to scope after work begins are priced as change orders and must be approved in writing.

Workmanship and materials warranties, if any, are stated in your proposal or sales agreement; materials otherwise carry the manufacturer's warranty.

Buy-Back Program

Our buy-back program allows you to receive a quote for your existing spa. Quotes are based on the information and photos you provide and are confirmed at inspection. A quote is not binding until we inspect the unit and issue a written offer.

Returns and Refunds

Because spas are large, one of a kind, and installed at your property, we do not accept returns or exchanges once a unit has been delivered, except as required by law or as stated in your sales agreement or an applicable manufacturer warranty. Deposits and cancellations are addressed under Orders, Deposits, and Payment above.

Bookings and Appointments

Showings, virtual showings, phone consults, and buy-back consults booked through the Site are free unless the booking page says otherwise. Please cancel or reschedule at least 24 hours in advance.

Website Use

Content on the Site, including photos, product descriptions, and blog posts, belongs to us or our licensors and may not be copied for commercial use without permission.

Product photos may show optional features or colors; the listing text and your sales agreement describe what is included.

You agree not to misuse the Site, scrape its contents, or interfere with its operation.

Links to third-party sites are provided for convenience; we are not responsible for their content or practices.

Text Messaging Terms

By opting in to text messages from TX Spa Guy (C&A Sales LLC), you agree to receive appointment reminders, order and delivery updates, and occasional marketing offers at the number you provide. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out and HELP for help. Consent is not a condition of purchase. Our Privacy Policy explains how we handle your mobile information.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TX SPA GUY'S TOTAL LIABILITY ARISING OUT OF ANY PURCHASE, SERVICE, OR USE OF THE SITE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE AT ISSUE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, WATER OR ELECTRICITY COSTS, OR DAMAGE TO DECKS, PADS, OR LANDSCAPING RESULTING FROM SITE CONDITIONS YOU ARE RESPONSIBLE FOR UNDER THESE TERMS. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Governing Law and Disputes

These Terms and every transaction with us are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or a transaction with us will be brought in the state or county courts located in Wise County, Texas, and you consent to the jurisdiction and venue of those courts. Before filing any claim, you agree to contact us at sales@txspaguy.com and give us 30 days to try to resolve the issue.

Changes to These Terms

We may update these Terms from time to time. The effective date at the top shows when they were last revised. Changes apply to orders placed after the change.
